User Agreement

By using the buynatural.com.au website (and our App, mobile site, and social media pages, collectively “Website”), you accept these terms and conditions (“Terms of Service”) and our Privacy Policy. This Agreement is between you and BuyNatural Australia (referred to as “we”, “us” or “our”). We may change these terms at any time; changes will be posted on the Website. By continuing to use the Website, you agree to be bound by the updated terms.

Registration and User Requirements

We allow guest checkout, but you may register as a member to access additional features. When registering, you must provide accurate and current personal information, including your name, address, and a valid email address.

By using the Website, you consent to receive direct marketing communications to the email address you provide, from which you may unsubscribe at any time. Your consent to some communications may be implied from use of certain service features (e.g. cart reminders).

To register or use the Website, you must be at least 18 years old, have a current Australian residential address, and have legal capacity to enter into a binding agreement.

Access and Use of the Website

You must only use the Website through the interfaces provided, and in accordance with these terms and applicable law.

You must not interfere with or disrupt our site or its servers.
You must not use data mining, robots, screen scraping or similar tools.
You must not interfere with security-related features.
You must not use, copy or distribute content without our express permission.

Fraudulent, abusive, or illegal activity may be referred to the relevant authorities. You are solely responsible for all activity on your account, and must keep your password secure. We are not liable for unauthorised account activity if you fail to secure your login information.

You must not use another member’s account without express permission. If you suspect unauthorised use, notify us immediately and take steps to re-secure your account.

We do not guarantee Website availability at all times and are not responsible for content on linked websites.

Information on this Website

Product information is based on supplier or manufacturer material. Except as required by law (including Australian Consumer Law), we are not responsible for inaccuracies or errors caused by third party information. You agree to verify product information and suitability before purchase.

Some actual goods may differ slightly in appearance from Website images due to photographic and screen limitations.

Disclaimer and Liability

To the fullest extent permitted by law, we exclude all liability to you or anyone else for loss or damage of any kind relating to the Website, including but not limited to:

Errors, mistakes or inaccuracies on the Website or our social pages
Your actions based on information from the Website or linked sites
Personal injury or property damage from accessing or using the Website
Unauthorised access to secure servers or personal/financial information
Interruptions or transmission failures

Where the law (including Australian Consumer Law) provides a guarantee that cannot be excluded, our liability is limited to that guarantee.

Except as required by law, we, our affiliates and suppliers are not liable for any loss or consequential damages from the use of the Website or this Agreement. You are solely responsible for the legality of your actions.

Indemnity

You will indemnify us and our directors, officers, employees and agents from any loss or liability (including legal costs) arising from your conduct or breach of this Agreement.

Placing Orders

You are responsible for any discrepancies or errors in your order. The promotion of goods/services on the Website is not an offer to sell, but an invitation to treat. Orders are offers to purchase under these terms and any Seller terms at the price specified (including delivery and charges).

Goods are not reserved in-cart; an order is only finalised once you complete checkout and payment is received in full.

We use automated fraud detection software, which may result in delays or cancellations if fraud is suspected. We reserve the right to reject and refund orders at our discretion.

Your order may be rejected for suspected fraud, shipping issues, or Website errors in price or product description; if so, you will be refunded in full.

Please review your order carefully before confirming. Once confirmed, you cannot cancel or change your order. If you change your mind, see our Returns & Replacements Policy.

If we cancel or cannot fulfil your order, we will refund any payment received. Goods may become unavailable beyond our control; in that event, you may receive a refund or store credit.

Guest Checkout

You may purchase via Guest Checkout without creating an account. We will collect the personal information you provide in accordance with our Privacy Policy.

Price, Payment and Discount Codes

Prices and charges are in Australian dollars. All payments must be received in full prior to dispatch. If payment is not received, we cannot hold items against your order.

Discount codes are valid for a single transaction and not combinable with other offers. We may cancel transactions or codes if abuse is detected (such as use across multiple accounts by the same individual).

International Sellers and Direct Import Goods

Some Sellers may be based overseas. Imported goods may require you to comply with Australian laws and standards. Orders over $1,000AUD may be subject to additional GST by Australian Customs. For details, see www.border.gov.au.

Store Credits

Unused store credit will be credited to your account. We may change store credit terms with notice on the Website. Credits expire after 12 months unless otherwise stated. Promotional credits expire after 3 months. Store credits cannot be redeemed for cash or gift cards, and do not count toward promotional minimum spend.

Shipping and Delivery

Goods will be supplied as per your order confirmation by email. We will use best efforts to meet stated delivery times, but delays may occur. Please allow up to 30 days for delivery. Shipping charges are shown at checkout. Certain goods may incur extra fees. Some orders may not require signature and may be left in a safe place per Australia Post guidelines.

We are not responsible for late delivery where attempted delivery occurred on or before stated timeframes, or for lost/missing parcels signed for at your address.

Packaging and Labelling

We aim to depict goods accurately, but actual items may differ in appearance or packaging. Read all labels and instructions before use, especially for imported goods.

Change of Mind Returns

You may return goods for refund or exchange if:

Returned within 30 days of receiving order
As new, not used or opened, with all original packaging and tags intact
In a resalable condition and not damaged

Change of mind returns will incur a restocking fee (see our Returns & Replacements Policy).

You are responsible for the cost and risk of return shipping. Some goods (e.g. intimates, perishable goods, cosmetics, media, made-to-order goods, large/bulky items, etc.) are excluded from change of mind returns. For full details, see our Returns & Replacements Policy.

Availability of Goods

From time to time, goods may be out of stock or unavailable. If this continues for more than 14 days, we may refund you. We may withdraw or suspend goods from sale at any time without notice. In case of errors on the Website, we may reject affected orders and refund payments.

Problems with Your Goods

If you have a problem with your goods, please contact us. We will investigate and advise on returns if required. For manufacturer warranty items, you may contact the manufacturer directly or us for assistance. You are responsible for return shipping unless unreasonable; we may arrange collection for bulky items. Refunds are processed to the payment method used. Store credits are credited to your account. We aim to process refunds/replacements within 28 days.

Defective Goods

All goods are sold with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality. See our Returns & Replacements Policy for details.

Some goods include manufacturer warranties; these are separate from your rights under Australian Consumer Law. Contact the manufacturer or us as appropriate.

Social Media and Content

Content posted on or linked from our Website or social media is the responsibility of the originator. We do not control or accept liability for third-party content. By using our Website or social media pages, you may be exposed to objectionable content.

You agree you are responsible for any content you submit, and must not post content that is unauthorised, infringing, defamatory, misleading, discriminatory, offensive, obscene, or otherwise unlawful. We reserve the right to remove any content at our discretion.

We may retain server or backup copies of your content, even if removed from public view.

Intellectual Property

All content, graphics, trademarks, logos, code, and other materials on the Website are owned or licensed by BuyNatural or third parties, and protected by intellectual property laws. You may not use, copy, or distribute any material without permission.

By corresponding or communicating with us, you grant us a perpetual, royalty-free licence to use your content, including publishing testimonials or using your ideas for improving our services.

Transfer and Assignment

If BuyNatural Australia merges, is sold, or changes control, we may disclose your personal information and assign agreements with you to a third party.

General

We are not liable for delays outside our reasonable control. This Agreement is governed by the laws of New South Wales, Australia. If any part is void or unenforceable, it will be severed without affecting validity of the remainder. Our failure to enforce a right does not constitute a waiver. Waivers must be in writing.
